Terms of Service

These Terms of Use (“these Terms”) set forth the conditions for use of the services provided by Infinity Inc. (the “Company”) on this website (the “Services”). Registered users (“Users”) use the Services in accordance with these Terms.

Article 1 — Application

These Terms apply to all relationships related to the use of the Services between the User and the Company.

Article 2 — Registration for Use

Registration for use is completed when an applicant applies for registration by the method designated by the Company and the Company approves it. The Company may decline an application for registration if it determines that the applicant falls under any of the following reasons, and bears no obligation to disclose the reason:

  1. The applicant provided false information when applying for registration.
  2. The application is from a person who has previously violated these Terms.
  3. Otherwise, the Company determines that registration is not appropriate.

Article 3 — Management of User ID and Password

The User manages the user ID and password of the Services at their own responsibility.

The User may not transfer or lend the user ID or password to a third party under any circumstances. If a login is made with a combination of user ID and password that matches the registered information, the Company deems that the use is by the user who registered that user ID.

Article 4 — Usage Fees and Payment Methods

The User pays the usage fees, which the Company separately determines and displays on this website, by the method designated by the Company, as consideration for using the Services.

Article 5 — Prohibited Acts

The User must not engage in the following acts when using the Services:

  1. Acts that violate laws or public order and morals.
  2. Acts related to criminal acts.
  3. Acts that destroy or interfere with the functions of the Company's servers or network.
  4. Acts that may interfere with the operation of the Company's services.
  5. Acts of collecting or accumulating personal information of other users.
  6. Acts of impersonating another user.
  7. Acts of providing benefits, directly or indirectly, to anti-social forces in connection with the Company's services.
  8. Other acts that the Company deems inappropriate.

Article 6 — Suspension of Services

The Company may suspend or interrupt the provision of all or part of the Services without prior notice to the User if it determines that any of the following applies:

  1. When performing maintenance, inspection, or update of the computer system related to the Services.
  2. When the provision of the Services becomes difficult due to force majeure such as earthquakes, lightning, fire, power outage, or natural disasters.
  3. When a computer or communication line stops due to an accident.
  4. Otherwise, when the Company determines that the provision of the Services is difficult.

The Company bears no responsibility, regardless of reason, for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the Services.

Article 7 — Restriction of Use and Deletion of Registration

The Company may restrict the use of all or part of the Services, or delete the User's registration, without prior notice in the following cases:

  1. When the User violates any provision of these Terms.
  2. When it is found that the registered information contains false facts.
  3. Otherwise, when the Company determines that the use of the Services is inappropriate.

The Company bears no responsibility for any damage suffered by the User due to acts performed by the Company under this Article.

Article 8 — Disclaimer

The Company's liability for non-performance of obligations is exempt unless due to the Company's intentional act or gross negligence.

Even when the Company is liable for any reason, it is liable only within the scope of damages that would normally occur, and within the scope of the fee amount (in the case of continuing services, the equivalent of one month's fee) for paid services.

The Company bears no responsibility for transactions, communications, or disputes between the User and other users or third parties regarding the Services.

Article 9 — Changes to Service Content

The Company may change the content of the Services or discontinue the provision of the Services without notice to the User, and bears no responsibility for any damage suffered by the User as a result.

Article 10 — Changes to the Terms of Use

The Company may change these Terms at any time without notice to the User when it determines it necessary.

Article 11 — Notices or Communications

Notices or communications between the User and the Company are made by the method designated by the Company.

Article 12 — Prohibition of Assignment of Rights and Obligations

The User may not assign or provide as collateral the position under the usage contract or the rights or obligations under these Terms to a third party without the prior written consent of the Company.

Article 13 — Governing Law and Jurisdiction

Japanese law governs the interpretation of these Terms. In the event of a dispute regarding the Services, the court with jurisdiction over the location of the Company's head office is the exclusive agreed jurisdiction.
